The View of the National Human Rights Commission of Korea on
the Fourth Phase of the World Programme for Human Rights Education
The National Human Rights Commission of Korea (hereinafter referred to as “the
Commission”) endorses the UN Human Rights Council"s resolution adopted in 28 September
2017 with the view that the human rights education should be taken as an important first step
towards the 2030 Agenda for Sustainable Development. In addition, the Commission would
like to emphasize that the fourth phase of the World Programme for Human Rights Education
(hereinafter referred to as “the World Programme”), which is founded upon the consensus
and collaboration among international community, should be noted as the global common
guideline of human rights education and an essential stepping stone to effectively promote
human rights education.
The Commission empathize with the view that stresses the need for global community to take
on the human rights education perspective and actively seek out to resolve the issue of hatred
and discrimination against minorities and the violation of human rights, which are commonly
experienced worldwide. In this context, greater spotlight is bestowed upon the increasingly
important role of fourth phase of the World Programme.
While engaging the domestic civil society and reviewing past outcomes in the process of
setting up the ground for the fourth phase of the World Programme, the Commission is
concerned that its view submitted for the establishment of the fourth phase will only be used
in a mere formality. This concern is rooted in the reality where the Republic of Korea is yet to
sufficiently anchored down human rights education based on the previous programmes,
including the first, second and third phases, and that each Member State may focus on
different aspects of human rights education based on their strategical interest and context.
Under this premise, the Commission requests for an intensive review on the following
Commission"s view, with close consideration to the view of domestic civil society, for the
preparation of fourth phase of the World Programme.
1. Thematic Human Rights Issues and Focus Areas
1.1. Human rights of women
Just as the global initiatives to promote human rights of women is growing stronger,
including the emergence of the “Me Too Movement”, the Korean society is currently
facing a strong public uproar against gender-based violence. The victimized women have
started to and continues on exposing their past experiences of gender-based violence,
which in turn, called for an overall change across social institutions and culture. The
discriminatory culture and practices against women in the traditionally patriarchal Korean
society has been prevalent in family units and organizations. In order to arise above the
past practices and improve the general awareness, the need for legal reforms and human
rights education is ever stronger.
In order to do so, the human rights education that focuses on building values through sex
education and programmes on gender equality and relationship-building based on human
rights approach should be conducted across schools and work places. In addition, the
global best practices and models, including the use of cultural medium, need to be shared
among the National Human Rights Institutes (NHRIs) and implementers of human rights
education for the effective promotion of basic human rights of women in each country,
where socio-cultural values varies from one another.
1.1. Human rights of sexual minorities
The issue of violation against the human rights of sexual minorities occurs in the context
of monolithic and hierarchical gender binary-oriented culture and institutions. Particularly,
in the Korean context, human rights violations committed by some of influential religious
groups have reached a concerning level, whereas these religious groups are openly
spreading campaign for the discrimination of sexual minorities and the opposition of their
human rights. Due to the political influence held by the counter-human rights campaign of
these religious groups, the long-cherished goal of the Commission to enact the Human
Rights Education Support Bill, which is also the core element of institutionalization and
systematization of human rights education, is being delayed without foreseeable outcome.
Moreover, the human rights ordinance of regional local government, Chungcheongnam-do,
has been recently abolished. The UN Special Rapporteur on Sexual Orientation and
Gender Identity has already submitted the letter to the Korean Government, urging it to
provide measures to protect human rights of sexual minorities.
Considering the recent Korean context, the UN should provide a common and detailed
human rights education guideline on the protection of human rights of sexual minorities.
For example, the concept of gender equality embedded in the Goal 4, target 7 of the
Sustainable Development Goals (SDGs) should be clearly and explicitly expressed, that it
encompasses the sexual minority groups and is moving away from the gender binary
approach. By underlining the explicit definition, arbitrary interpretation of gender equality
and exclusion of sexual minorities from the premise should be prevented.
1.2. Human rights of immigrants
While that immigration is recognized as an unavoidable structural phenomenon caused by
unequal distribution of resources, political atmosphere and cultural context, in present
sovereign state system, the immigrants are facing discriminatory conditions that either
completely excludes, or only partially recognizes them as the subject of guarantee of rights.
While the immigrant population in Korea has reached two million, the poor human
rights conditions of immigrants continues on. A numerous cases, where immigrants
who experienced sexual harassment and gender-based violence are unable to actively
seek out remedial measures and those who have been affected by industrial accidents
are unable to receive proper compensation or benefit from the industrial accident
compensation insurance and related policies, have occurred. Such problems are
intensified not only because of insufficient legal system, but also because of the lack
of prior human rights training. Human rights education focusing on the protection of
immigrants" human rights is needed in order to remedy the situation.
Furthermore, the human rights education for immigrants should be conducted not only
for immigrants but also civilians in order to raise awareness. According to the “2016
Survey on National Awareness on Human Rights” conducted by the Commission,
72.7% of general population and 85.5% of experts have mentioned foreign
immigrants as the most fragile group in terms with the enjoyment of human rights in
the Korean society. The “2016 Monitoring Survey on Racial Discrimination”,
conducted by the Gyeonggi-do Human Rights Support Center for Foreigner, has
observed that the trend of expression of racial discrimination and hatred are being
widely spread in Korea. The survey further indicated that the practice of racism in
education system and institutional space, which can be identified as institutional
racism, are also running rampant.
In such context, human rights education that focuses on mutual understanding and
targets both immigrants and general population are needed in order to build capacity
of immigrants and prevent racial discrimination in Korea.
1.3. Labor rights and human rights-based business management
As the Korean labor market polarization between permanent and temporary contracts is
intensifying, the labor conditions subjected by temporary contract, such as job security
and low-level salary, are rapidly deteriorating. It should be noted that corporate activities,
in the context of capitalist society, is founded upon the human rights violations that
reaches out to laborers of developing countries, consumers and indigenous persons.
In this context, it is increasingly important to identify different interest groups and their
characteristics, including laborer, consumer, indigenous persona and etc., affected by the
activities of business firms, and to provide human rights education in order enable interest
groups to promote and protect their own rights. Recently, caregiving industry for children
and old persons is extensively growing; however, the caregivers are still exposed to
inadequate working conditions. The inadequate working conditions negatively affect the
quality of caregiving service, and at times, lead to abuse committed upon children or old
persons, whom should be the recipient of care. In this sense, the human rights education
should be further emphasized for its role committed to enhance the level of societal
respect payed to caregivers and their working condition.
Moreover, with the recognition of corporate business sector"s influence in regards to the
protection and promotion of the rights of individuals of the modern society, human rights
education should also be provided to entrepreneur and business management, so as for
them to incorporate human rights-based approach in their businesses.
1.4. Human rights of older persons
Through the global trend of demography ageing, some countries has already entered into
the stage of ageing society. The efforts of international community is increasingly
important to foster environment where older persons can enjoy life. The Republic of Korea
has rapidly entered into the stage of ageing society in 2017, with population above 65
years of age reaching 14% of total population.
If the country enters into the stage of rapidly ageing society, just like the case of Korea,
without adequate social security infrastructures for older persons, the country is in risk of
human rights problems including “elderly poverty”, “abuse against older persons” and
“suicide of older persons”. Older persons should be able to independently participate in
society as one of its stakeholders, and that would require the guarantee of the rights to
dignity and liberty and social rights, and the human rights education targeting older
persons and civilians with specific focus on the guarantee of older person.
1.5. Press and media environment
As stated by the third phase of the World Programme, the cases of human rights violation
is increasing in the rapidly changing media environment, and a great need exists for the
human rights education to specify human rights issues related to media.
Personal online broadcasting channels are currently exhibiting culture of excessive violent
and sexual expression, verbal abuse, disparagement against disabled persons, and hate
expression against women. The concern on the culture of online broadcasting channel has
reached alarming level, and demands for the human rights education reaching out to online
contents producer and consumers.
2. Main Target Sector and Education Method
1.1. Main target sector
Recently, human rights of women has been placed under spotlight in the Korean society.
The spotlight was triggered by the “Me Too Movement” and cases of gender-based hatred,
which stemmed from the low human rights awareness level of men who hold higher
authority and power. In relation to this context, human rights education with men as
participant target group should be promoted.
Moreover, special attention and supports are needed for the older persons who had no
previous access to the human rights education. Older person should be able to recognize
and claim their human rights, while certain level of civic capacity is needed to enable
respect for others" rights in the context of diverse social relations, including
intergenerational relations and relationships among older persons.
1.2. Education Method
While the human rights education is carried out through education system and public
sphere, it is important to further develop human rights education system that reaches out to
out-of-school children and youth, private sector including businesses, and other civilians.
As the human rights situation is constantly changing, it is important to follow up human
rights education on individual level, so an individual will be able to undergo periodic and
progressive human rights education system through citizenship education, life-long
learning and other related programmes. In this sense, human rights education programmes
should set selected goals for different stages of life cycle? infancy, childhood, youth,
middle age, older persons and etc. Such goals includes strengthening the sense of others
for infancy, and emphasizing the importance of labor rights for youth.
3. Education Curricula
The human rights education should encompass the following:
- A level of basic understanding of human rights principles and related issues
- An understanding of individual"s self-actualization and liberty, including the
protection of personal liberty, rights to education and health and labor right
- The importance of solidarity and coalition of citizens, such as the promotion of
At least a simple definitions of basic terminologies? such as capacity building,
autonomy, rights, fundamental freedom, responsibility and others? used in the guidelines
should be provided. The definitions commonly found in the human rights education is
used to provide direction and not to standardize the concepts.
Specific cases concerning “actions that protect and promote human rights” should be
provided. Explicitly examples of participation practices of proactive citizenship in
workplace, school and community needs to be provided.
The human rights education curricula needs to cover an understanding on public interest.
The Action Plan of the World Programme should provide concrete framework for action
in order for the human rights education to go beyond the education on human rights, but to
provide education through human rights and become education for human rights.
Building school environment based on human rights principles is utmost important in
order to promote education conveying human rights. The following human rights
and participation in human rights advocacy groups and organization, the level
of social welfare, and the consideration of all forms of human relations, and
hate and discrimination issues
- An understanding on equality and social justice, including issues on income
inequality, gender equality, and the right to enjoy culture and public services
- The importance of respect to other species and environment with considerations
to animal rights, ecological footprints, pollution and carbon dioxide emission
- The factors that influence violation of human rights should be clearly explained.
The structural or background interfering factors which hinders guarantee and
realization of human rights should be explicitly stated. As such, it is necessary
to explicitly narrate cases of abuse committed by enterprises, workplace
bullying, colonialism, gender discrimination, discrimination against disabled
persons and familism.
- Human rights education is only applicable in real life when practical cases of
abstract norms and principles are established, shared and incorporated into the
curricula.
programmes can contribute to build human rights friendly environment:
4. Systematization of Training Course for Human Rights Educators
As the role of human rights educator is increasingly important, there is a great need to
systematize the training course for human rights educators.
The international community should provide capacity building opportunities to human
rights educators, so as to deliver internationally agreed human rights values. The United

Nations should establish corresponding financial and educational system to fulfill this goal.
5. Evaluation of Human Rights Training
It is necessary to develop set of indicators to measure the outcomes of human rights
education in order to enable regular monitoring and evaluation. The existing indicators has
strong quantitative characteristics, which necessitates the development of the qualitative
indicators.
6. Diversification of Human Rights Education Courses
Artistic activities such as paintings, and music are universal and accessible medium that
can enhance the effectiveness of human rights education. Moreover, the result of artistic
activities could be shared more easily across borders. Considering this, there is a greater
need to provide human rights education learning method which utilizes painting, music
and other artistic activities. Forums on human rights education could be hosted to facilitate
and strengthen international cooperation.
7. Reinforcement of NHRIs" Responsibilities and Roles
The NHRIs play important domestic roles in implementation and monitoring of human
rights education programmes, and coordination and facilitation of engagement among
different actors of human rights education. Their roles and responsibilities should be
explicitly stated through the UN.
Moreover, the importance of human rights education legislations should be further
emphasized in order to promote enactment of legislations, to guarantee right to human
rights education, and to obligate central and regional government to provide human rights
education. In addition, it should explicitly state that each government, with responsibility
to protect and promote human rights, should provide financial support, human resources
and adequate locations to the NHRIs in regards to ensuring the specialization of NHRIs
and implementer of human rights education, and the effective implementation of broad
range of topics covered in the World Programme.

the Fourth Phase of the World Programme for Human Rights Education
