모집·운송·이전·은닉·인계(the recruitment, transportation, transfer, harbour-
ing or receipt of persons)

Adjudication of the Standing Commission of
the National Human Rights Commission of
Korea
Title: Recommendation on Indicators for the Identification and
Protection of Victims of Trafficking In Persons
Formal Adjudication
It is recommended by the National Human Rights Commission of Korea
(NHRCK) that Minister of Justice, Minister of Employment and Labor,
Minister of Gender Equality and Family, Commissioner General of
Korea National Police Agency, and Governors and Mayors of regional
local governments shall utilize and come up with specific measures of
Indicators for the Identification and Protection of Victims of Trafficking
in Persons in order to raise social awareness about trafficking of
persons.
Reason
Ⅰ. Background of the recommendation
As Trafficking in Persons (hereinafter as “TIP”) has surfaced as a
global issue, and the UN adopted United Nations Convention against
Transnational Organized Crime, Republic of Korea also strengthened
regulation on the same matter by amending Criminal Act in April, 2013
to add a provision of “Trafficking in Persons (Article 289).”

However, while the understanding of our society of the TIP still
focuses on the narrow definition of selling and buying persons like
goods, Protocol to Prevent, Suppress and Punish Trafficking in Persons
Especially Women and Children, supplementing the United Nations
Convention against Transnational Organized Crime (“UN Protocol to
Prevent Trafficking in Persons” hereinafter) broadly defines the TIP as
“the recruitment, transportation, transfer, harbouring or receipt of
persons, by means of the threat or use of force or other forms of
coercion, of abduction, of fraud, of deception, of the abuse of power or
of a position of vulnerability or of the giving or receiving of payments
or benefits to achieve the consent of a person having control over
another person, for the purpose of exploitation.
As National Assembly ratified the UN Protocol to Prevent Trafficking in
Persons on May 29, 2015, which entered into effect in Korea as of
December 5, 2015, legislation and system now needs to be established
for domestic implementation of the International Convention on the TIP.
In addition, UN Human Rights Committee recommended in November
2015 that Korean government shall “strengthen the definition of
Trafficking in Persons in accordance with the international standard,
identify the victims, and provide all the necessary support.”
To this end, as more detailed indicators are needed to better identify
and protect the victims of the TIP to the judgment of the Commission,
it reviewed the introduction of Indicators for the Identification and
Protection of the Victims of Trafficking in Persons pursuant to Article
19 Subparagraph 1 of National Human Rights Commission Act.

The Indicators will help comply with the International Convention on
the TIP, improve public awareness and understanding about the TIP,
and identify presumed victims at an early stage to prevent human
rights violation and promote human rights protection.
Ⅱ. Judgment and reference
The judgment was based on Articles 3, 6, and 7 of the UN Protocol to
Prevent Trafficking in Persons, and general indicators of the UN Office
of Drugs and Crime (UNODC).
Ⅲ. Main contents of the Indicators for the Identification and
Protection of the Victims of Trafficking in Persons
1. General Provisions
The purpose of the Indicators for the Identification and Protection of
the Victims of Trafficking in Persons is to help Ministry of Justice,
Ministry of Employment and Labor, Ministry of Gender Equality and
Family, Korea National Police Agency, and local governments identify
and provide support for the presumed victims of the TIP at an early
stage by establishing relevant standards that referred to the general
index of the UNODC but better reflect our societal reality.
Indicators for Identification set three categories of act, means, and
purpose based on the definition set forth in the Article 3 of the UN
Protocol to Prevent Trafficking in Persons to help identify victims of
the TIP through the interlinked indexes. Index for Protection provides
ground for shelter referral, police measures, immigration measures,
medical service, prevention of further damage, based on the Articles 6
and 7 of the Protocol.

2. Definition of Trafficking in Persons
Trafficking in Persons means the recruitment, transportation, transfer,
harbouring or receipt of persons, by means of the threat or use of
force or other forms of coercion, of abduction, of fraud, of deception,
of the abuse of power or of a position of vulnerability or of the giving
or receiving of payments or benefits to achieve the consent of a
person having control over another person, for the purpose of
exploitation. Exploitation shall include, at a minimum, the exploitation
of the prostitution of others or other forms of sexual exploitation,
forced labour or services, slavery or practices similar to slavery,
servitude or the removal of organs, and consent of a victim is
irrelevant.
3. Indicators for the Identification of the Victims of Trafficking in
Persons
The basic direction of the identification indicators is to help identify
victims of the TIP at an early stage according to relevant international
and domestic standards while promoting the recognition of potential
victims in a situation where three elements of act, means, and purpose
are interlinked with one another. Main contents of the identification
indicators are as follows:
First, while the act of the TIP under the UN Protocol to Prevent
Trafficking in Persons comprises five elements of recruitment,
transportation, transfer, harbouring, or receipt, the identification index
incorporates the first two elements of transportation and transfer into
“이동,” constituting one of the four elements of act of the TIP.

Second, in order to determine whether a victims was under threat,
force, kidnapping, fraud, or deceit, or whether there was an abuse of
power, or exploitation of a victim"s vulnerability, three elements serve
as indexes for means of the TIP.
Third, while the Protocol include five forms of exploitation including
recruiting for the purpose of exploitation and use of coercion, the
Indicators center around sexual and labor exploitation to better reflect
the reality of our society.
A trafficker (or recruiter) uses one or more economic, physical, and
emotional control measures including personal detention due to financial
debts, isolation, confiscation of I.D card, using violence, terrorizing,
retaliation and threat against families, etc. in order to sustain exploitive
structure over a victim. Therefore, indexes are grouped according to
different measures of control, under which eight items of “certain” and
twelve items of “probable and possible” are on a checklist: one or
more of “certain” items, and two or more of “probable” and “possible”
ones confirm the purpose of trafficking.
4. Indicators for the Protection of the Victims of Trafficking in
Persons
In order to provide appropriate measures for protection of safety and
human rights of a victim during investigation or court proceedings after
the identification as a victim of the TIP, fifteen times are included in
the Protection Indicators with reference to Articles 6 and 7 of the
Protocol.

Indicators for the Protection include one item of referral to shelters,
five items of police-related measures, three items of
immigration-related measures, two items of medical service provision,
and four items of protection from further damage.
Ⅳ. Conclusion
With these reasons, and pursuant to the Article 25 Paragraph 1 of
National Human Rights Commission Act, National Human Rights
Commission of Korea hereby concludes to recommend as written in the
formal adjudication.

ing or receipt of persons)
